1. Purpose of the Service

Escapor is a digital software platform provided exclusively through a mobile application (iOS and Android). The service offers AI-assisted tools for group travel planning, including itinerary suggestions, organizational features, and informational recommendations. The public website of Escapor operates solely as a marketing, informational, and blog showcase and does not provide access to the software service. Escapor acts exclusively as a software editor and information platform. Escapor is not a travel agency, tour operator, reseller, intermediary, or organizer of travel services.

2. Acceptance of the Terms

By accessing or using the Escapor mobile application, users acknowledge that they have read, understood, and accepted these Terms & Conditions.

3. User Accounts & Eligibility

User accounts are created and used exclusively within the Escapor mobile application. Users must be at least 18 years old, or the age of legal majority in their jurisdiction, to create an account and use the Escapor mobile application. Users are responsible for the accuracy of information provided and for maintaining the confidentiality of their credentials.

4. Legal Qualification & Role of Escapor

Escapor:

• does not book, sell, or resell travel services;
• does not guarantee prices, availability, or quality of third-party services;
• does not act as an agent, organizer, or contractual intermediary;
• provides informational content and technical tools only.

5. Active Features vs Future Features

Current features are limited to software-based planning, organization, and informational tools. A future and currently inactive feature may allow users to connect with each other for peer-to-peer (C2C) equipment sharing. At the date of these Terms:

• no payments are processed;
• no commissions are charged;
• no logistics or insurance are provided;
• Escapor is not a party to any agreement between users.

6. User Responsibilities

Users are solely responsible for: • their travel decisions; • compliance with applicable laws; • interactions with third-party providers or other users; • content they publish on the platform.

7. Third-Party Services

Escapor is not responsible for the content, performance, pricing, availability, or conduct of third-party services.

8. AI Disclaimer

AI-generated content is provided for informational purposes only, is non-contractual, and may contain inaccuracies. Users must independently verify all information.

9. Pricing & Payments

Escapor may offer free and paid SaaS features (freemium, subscriptions, tokens, or similar). Payments relate exclusively to access to Escapor's software features.

10. Right of Withdrawal

Where mandatory under applicable EU or UK consumer law, users may exercise their right of withdrawal. For digital services, the right of withdrawal may be excluded once performance has begun, provided that the user has given prior express consent and acknowledged the loss of this right. Such consent may be collected through an explicit confirmation mechanism during the in-app purchase flow.

11. Suspension & Termination

Escapor may suspend or terminate access to the application, remove content, or restrict accounts at its sole discretion, particularly in cases of fraud, abuse, misleading content, illegal activity, or violation of these Terms.

12. Limitation of Liability

Escapor's liability is limited to direct damages resulting from a proven malfunction of the software, within the limits permitted by applicable law. Escapor shall not be liable for indirect or consequential damages.

13. Intellectual Property

All intellectual property rights related to the application and its content remain the exclusive property of Escapor or its licensors.

14. Governing Law & Jurisdiction

These Terms are governed by Bulgarian law. For consumers residing in the European Union or the United Kingdom, legal proceedings may also be brought before the competent courts of the consumer's place of residence, in accordance with mandatory consumer protection laws.

15. Modification of the Terms

Escapor may update these Terms from time to time. Users will be informed of material changes through reasonable means, such as an in-application notice or email notification, prior to the changes taking effect where required by applicable law. Continued use of the application after the effective date of the updated Terms constitutes acceptance of the revised version, except where additional user consent is required by applicable law for material changes.

16. Dispute Resolution

Before initiating any formal legal proceedings, users are encouraged to contact Escapor in order to seek an amicable resolution. Where applicable, users may also have access to alternative dispute resolution or mediation mechanisms in accordance with mandatory consumer protection laws. 17. Severability

If any provision of these Terms is held to be invalid, unlawful, or unenforceable by a competent court, the remaining provisions shall continue in full force and effect.

18. Assignment

Escapor may assign or transfer these Terms, in whole or in part, to any affiliate or successor entity in connection with a merger, acquisition, restructuring, or sale of assets. Users may not assign their rights or obligations under these Terms without Escapor's prior written consent.

19. Force Majeure

Escapor shall not be held liable for any failure or delay in performance resulting from events beyond its reasonable control, including but not limited to natural disasters, acts of government, war, terrorism, labor disputes, network failures, or interruption of third-party services.

20. Entire Agreement

These Terms constitute the entire agreement between the user and Escapor regarding the use of the Service and supersede any prior agreements or understandings, whether written or oral.

21. No Waiver

Failure by Escapor to enforce any provision of these Terms shall not constitute a waiver of that provision or of the right to enforce it at a later time.

22. Survival

Provisions which by their nature should survive termination of these Terms shall survive, including but not limited to provisions relating to intellectual property, limitation of liability, dispute resolution, and governing law.

25. Acceptable Use Policy

Users may publish limited content within the application (such as travel plans, comments, reviews, social posts, chat messages, and marketplace listings). Users remain solely responsible for any content they submit. Escapor enforces a zero-tolerance policy against objectionable content and abusive behavior. We proactively filter user-generated content using automated moderation systems, and users can report content or block other users directly from the app. Content that is flagged or reported and found to violate these rules is removed within 24 hours, and users who provide abusive or objectionable content may be immediately and permanently banned from the service without refund. Prohibited uses include:

• fraud and scams
• misleading content
• illegal activity
• harassment
• impersonation
• scraping
• any misuse of the platform

26. Cookies & Tracking Technologies

Cookies are used only on the public website for: • strictly necessary technical functions • optional analytics (subject to user consent) The mobile application may rely on equivalent SDK technologies rather than browser cookies. Users may manage their preferences via the cookie banner displayed on the website.

27. Refunds & Cancellations

Escapor provides access to digital software services. No refunds are granted except where mandatory under applicable EU or UK consumer protection laws. No refunds apply to:

• third-party services;
• any user-to-user interactions or exchanges.
